RISK OF LOSS, RETURNS/REFUNDS & TITLE

The risk of loss and title for items purchased by you from Dennis Dillon RV, LLC’s online store or through any e-commerce platform pass to you upon delivery of the items to the carrier. TO THE FULL EXTENT PERMISSIBLE BY LAW, DENNIS DILLONS RV, LLC, DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DENNIS DILLON RV, LLC’S TOTAL LIABILITY TO YOU FOR ANY DAMAGES (REGARDLESS OF THE FOUNDATION FOR THE ACTION) SHALL NOT EXCEED IN THE AMOUNT YOU PAID IT FOR THE APPLICABLE PRODUCT. YOU AGREE THAT YOU WAIVE ALL CLAIMS AGAINST DENNIS DILLON RV, LLC, FOR CONSEQUENTIAL DAMAGES, LOST PROFITS, AND ALL OTHER DAMAGES ARISING FROM YOUR TRANSACTIONS WITH, AND PRODUCTS YOU PURCHASE FROM, DENNIS DILLON RV, LLC.  

DISPUTES, REMEDIES & APPLICABLE LAW

Any dispute or claim relating in any way to any representation, product, or service you receive from Dennis Dillon RV, LLC, must be resolved by binding arbitration. The arbitration will be conducted under and be governed by the laws of the State of Idaho, subject only to preemption by the Federal Arbitration Act, and these terms and conditions.

The arbitration must be conducted in Ada County, Idaho. The arbitrator must be located in Ada County, Idaho, or be willing to arbitrate the dispute without charging for travel to or from Ada County, Idaho.

You and Dennis Dillon RV, LLC, agree to split the arbitrator costs and fees regardless of who is the prevailing party.

Items listed in error at a sale price of $0.00 will not be honored.

You and Dennis Dillon RV, LLC, agree to waive all claims to recover from the other attorney fees or costs, regardless of whether the right to recover attorney fees or costs arises from statute, court rule, rules of arbitration, or common law. You and Dennis Dillon RV, LLC, agree that the arbitrator may not award attorney fees or costs to either party, even if the applicable arbitration rules permit such an award.

To begin an arbitration proceeding, you must serve a demand on Dennis Dillon RV, LLC’s registered agent, whom you may identify at www.sos.idaho.gov.

You and Dennis Dillon RV, LLC, agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, representative, or private attorney general action. If for any reason a claim proceeds in court rather than in arbitration, you and Dennis Dillon RV, LLC, waive any right to a jury trial, and waive all rights to recover from the other party attorney fees or costs, regardless of whether such right arises by statute, court rule, arbitration rule, or common law.

MODIFICATION & SEVERABILITY

Dennis Dillon RV, LLC, reserves the right to make changes to these terms and conditions at any time and without notice to you. Changes are immediately effective and apply to all disputes except those for which an arbitration proceeding has already been commenced. If any term or condition is deemed invalid, void, or for any reason unenforceable, that term or condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
